Domain Name Agreement

AltusHost B.V. (“AltusHost”, “we”, “us”, or “our”) resells top-level domains (TLDs), including gTLDs and ccTLDs. This Domain Name Agreement (“Agreement”) governs domain names registered through or transferred to AltusHost and any domain-related services (the “Domain Services”). This Agreement is an integral part of our Terms of Service (“TOS”) and must be read together with applicable Registry, Registrar, and ICANN policies.

1. ICANN Information for Domain Registrants

AltusHost provides domain name registration services as a reseller of ICANN-accredited registrars.
Domain name registrations are subject to ICANN policies, as well as the policies of the applicable Registry and sponsoring Registrar.

Upon request by a registrant, AltusHost will identify the applicable sponsoring registrar of record for a domain name, which may include Realtime Register B.V. or another ICANN-accredited registrar, depending on the TLD.


2. Linked Registrar and Registry Agreements

Depending on the TLD and the registrar of record, your domain name is also governed by additional Registry and/or Registrar agreements.
Including but not limited to agreements provided by PDR Ltd., Key-Systems GmbH (RRPproxy), and applicable ICANN policies such as the UDRP
and Registrant Rights and Responsibilities documentation.

AltusHost is not responsible for domains registered with third parties and merely used in connection with our Services.


3. Registration & Management

Ordering. You may request registration via an Order in the Client Portal. Registration is not guaranteed until you receive explicit confirmation
that the domain has been registered in your name.

Registry rules. All registrations and ongoing use are subject to the applicable Registry’s and/or Registrar’s policies, which are incorporated by reference.
A Registry may refuse, cancel, or transfer a registration at its discretion, in accordance with its policies or applicable law.

Management. For domains registered via AltusHost, you can manage contacts, nameservers, DNS, and renewals from your Client Portal, subject to availability and TLD-specific limitations.

Non-refundability. Domain registration, transfer, and renewal fees are non-refundable once submitted to the Registry. See also our Refund Policy.


4. Registrant Data & Accuracy

You must provide current, complete, and accurate contact details for the registrant, administrative, technical, and billing contacts, and promptly update them upon any change. Data requirements may vary by TLD and may change upon renewal.

If you submit data of a third party, you represent that you have notified them and obtained any required consent in accordance with applicable law and our Privacy Policy.

Certain registries and ICANN may require email or document verification following registration or contact changes. Failure to verify within the applicable timeframe may result in suspension or deletion of the domain.

Providing inaccurate or false data, failing to update information, or failing to respond to accuracy inquiries
may result in suspension or cancellation of the domain without refund.

The registrant contact determines domain ownership. Maintaining accurate registrant data is essential to preserving ownership records.


5. Publication of Data (WHOIS/RDAP), Privacy/Proxy

Registrant data may be processed and made available via WHOIS and/or RDAP services in accordance with Registry and ICANN policies and applicable data protection laws, including the GDPR. Data visibility varies by TLD.

Where available and ordered, Privacy or Proxy services may mask certain public WHOIS/RDAP fields.
You remain fully responsible for the domain and must respond to communications forwarded through proxy contact channels.

Privacy/Proxy services may not be available for all TLDs.


6. Identity Checks & Compliance

Certain TLDs, particularly some ccTLDs, require specific documentation such as local presence, company registration details, tax numbers, or trademark evidence. We, the Registrar or the Registry, may request such documentation to ensure compliance.

Orders flagged by fraud-prevention controls may require identity verification as described in our
Privacy Policy, including verification performed via iDenfy, before activation, transfer, or changes are completed.


7. Renewals, Expiry & Redemption

Domains generally renew automatically where auto-renewal is enabled, and payment is successful.
If auto-renewal is disabled or payment fails, you are responsible for renewing the domain prior to expiration.

After expiration, a domain may be suspended, placed on hold, and subsequently enter a Redemption Grace Period (RGP), where applicable. Restoring a domain during RGP incurs an additional fee set by the Registry or Registrar.

Not all TLDs offer a Redemption Grace Period.

Renewal, restoration, and premium pricing may change due to Registry pricing updates, policy changes, or currency fluctuations.


8. Transfers (Registrar of Record)

Transfers are governed by applicable Registry and ICANN transfer policies.
Only the current registrant or an authorized agent may initiate a transfer.

You must provide all required information, including Auth/EPP codes, unlock the domain, and ensure access to the registrant’s email address. Additional verification may be required.

Transfers may fail or be delayed for reasons beyond our control, including Registry restrictions, mandatory lock periods, disputes, or unpaid balances.


9. DNS, Nameservers & Suspension

You are responsible for DNS and nameserver configuration.
Propagation delays and third-party DNS issues are outside our control.

Unconfigured or expired domains may be parked on a default holding page, with or without advertising,
until renewed or properly configured.

We may suspend, lock, or modify a domain’s DNS configuration to comply with applicable policies,
legal obligations, court orders, or substantiated abuse reports, consistent with our
Acceptable Use Policy.


10. Disputes & Infringement

You are solely responsible for resolving disputes with third parties related to your domain name.
AltusHost is not a party to such disputes.

In the event of a UDRP or URS proceeding, or pursuant to a court order, we will comply with Registry and Registrar instructions, which may include locking, transferring, or canceling a domain name.

You represent and warrant that your registration and use of the domain name do not infringe the rights of any third party.


11. Fees, Taxes & Refunds

You agree to pay all applicable fees and taxes associated with domain services, including registrations, renewals, transfers, restorations, and add-ons.

Domain-related transactions are non-refundable once submitted to the Registry, as further detailed in our Refund Policy.


12. Customer Responsibility

All domains registered via AltusHost are associated with your Customer Account. You remain fully responsible for compliance with this Agreement, the TOS, and all applicable Registry and ICANN policies, regardless of any third-party use of the domain.


13. Termination & Changes

We may suspend or cancel a domain name in the event of policy violations, inaccurate data, fraud, non-payment, or where required by law or Registry or Registrar policy.

This Agreement may be amended in accordance with the TOS.
Continued use of Domain Services after changes take effect constitutes acceptance of the updated Agreement.
